FROM AND AGAINST ANY AND ALL THIRD PARTY CLAIMS, LOSSES, DAMAGES, LIABILITIES AND COSTS, INCLUDING WITHOUT LIMITATION REASONABLE ATTORNEY'S FEES AND COURT COSTS, ARISING OUT OF OR RELATING TO YOUR BREACH OF THIS AGREEMENT OR YOUR USE OF, ACCESS TO OR INABILITY TO ACCESS THE WEIGHTED VESTS FOR CHILDREN WEB SITE, EXCEPT TO THE EXTENT SUCH CLAIMS DIRECTLY RESULT FROM ORIGINAL DIAMOND DESIGNS INC. GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. THIS OBLIGATION SHALL SURVIVE TERMINATION OF THIS AGREEMENT OR OF ANY SERVICE PROVIDED BY ORIGINAL DIAMOND DESIGNS INC. TO YOU.

LIMITATION OF LIABILITY
ORIGINAL DIAMOND DESIGNS INC. BEARS NO RESPONSIBILITY OR LIABILITY, WHETHER IN TORT, CONTRACT OR OTHERWISE, ARISING IN ANY WAY OUT OF (1) ACCESS TO, USE OF OR INABILITY TO ACCESS OR USE THE VALEO SITES OR CONTENT, (2) ACCESS TO, USE OF OR INABILITY TO ACCESS OR USE ANY LINKED SITE, OR (3) ACTS OR OMISSIONS OF ANY SERVICE PROVIDER.

UNDER NO CIRCUMSTANCES SHALL VALEO BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE WEIGHTED VESTS FOR CHILDREN WEB SITE, INCLUDING WITHOUT LIMITATION ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER DATA ON COMPUTER SYSTEMS OR OTHERWISE, EVEN IF ORIGINAL DIAMOND DESIGNS INC. IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU MAY HAVE ADDITIONAL RIGHTS UNDER PREVAILING LAW, SO THE FOREGOING LIMITATIONS MAY NOT APPLY TO YOU.

COPYRIGHTS AND COPYRIGHT AGENT
Original Diamond Designs Inc. respects the rights of intellectual property owners. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Original Diamond Designs, Inc. with the following information, pursuant to Section 512 of Title 17, United States Code:

(1) an electronic or physical signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
(2) a description of the copyrighted work or works that you claim have been infringed;
(3) a description of the allegedly infringing material, including its location on the site;
(4) your address, telephone number, and e-mail address;
(5) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
(6) a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. ADDITIONAL PROVISIONS
Original Diamond Designs, Inc. shall not be liable for nonperformance or delay in performance caused by any event beyond Original Diamond Designs, Inc. reasonable control including, but not limited to, acts or omissions of service providers, equipment failure, war, strikes, lock-outs, unavailability of supplies, fire, flood, or any other Act of God, any law, regulation, ordinance, or other act or order of any court, government or governmental agency or delays, unavailability, errors or other failures of the Internet or other data networks.

Original Diamond Designs, Inc. makes no representation that any content is appropriate for use in any location other than the State of Florida.
